The Assam
government's action against child marriage is going on fast. More than 3000
people have been arrested in the state. Here, amidst the action of the Himanta
Biswa Sarma government, the Gauhati High Court has raised questions. The High
Court has raised questions regarding the application of the POCSO Act in cases
of child marriage. While granting pre-arrest bail to 9 accused under the POCSO
Act, the High Court said that these are not cases that require custodial
interrogation. Gauhati High Court Justice Suman Shyam said, 'POCSO! You can add

mean that the judges will not see what is there? We are not exonerating anyone
here. No one is stopping you from investigating .
The High Court asked, 'Is there any allegation of rape here?' While hearing the case, the Justice described the allegations as strange. He said, 'These are not such cases that custodial interrogation can be done. Proceed according to you (state) law. File a charge sheet and if they are convicted, then they are guilty. It is creating havoc in the personal lives of people where there are children, family members and old people.
